01 Scope

These terms apply to every package, project and Design Retainer subscription ordered from designplatinum, Wormser Str. 10, 60598 Frankfurt am Main, by businesses and consumers alike, unless we've agreed different terms with you in writing.

02 What we offer

designplatinum sells fixed-price design packages across six disciplines — Brand Identity & Strategy, Web Design & Development, UI/UX & Product Design, Motion & 3D, Packaging & Print, and Design Retainer — as published at /pricing/ and on each service page, plus bespoke scopes agreed individually where a published package doesn't fit.

03 Placing an order

Adding a fixed-price package to your cart and completing checkout is a binding request to purchase the listed service. The contract is concluded when we confirm your order and issue an invoice. For bespoke ("Request scope") work, the contract is concluded when both parties confirm the agreed scope and price in writing.

04 Prices & VAT

All prices shown are net, in Euro, excluding statutory VAT. VAT is added at checkout as a separate line, calculated as: 19% for orders billed within Germany; 0% (reverse charge) for EU orders with a valid, VIES-verified VAT ID; 19% for EU orders without a VAT ID; not subject to German VAT for orders billed outside the EU (§3a UStG).

05 Payment terms

For one-off packages, payment is invoiced in two stages unless stated otherwise on the package: 50% on order confirmation, due before kickoff begins, and the remaining 50% on delivery, due before final files and full usage rights are released. Design Retainer subscriptions are billed monthly in advance, starting on the order date. All invoices are payable within 14 days of the invoice date, on account (auf Rechnung) by bank transfer, unless a different method is confirmed at checkout.

06 Turnaround & delivery

Turnaround times stated per package run from the completion of the kickoff stage described at /process/, not from the order date, and assume timely client cooperation as described in that page's "Client responsibilities" section. A delay caused by late client feedback, content or access shifts the delivery date by the length of the delay.

07 Revisions

Each package states an included number of revision rounds. A revision round means consolidated feedback on a delivered stage, addressed in a single follow-up iteration. Revisions beyond the included rounds, or changes to the agreed scope itself, are quoted and agreed separately before being carried out.

08 Client cooperation

You agree to provide, in good time, the materials, access, content and feedback your package's process requires (see /process/#buying and each service page's process section). Delay in providing these shifts turnaround accordingly and does not constitute a breach by designplatinum.

09 Intellectual property & usage rights

Until full payment for a given stage or package, delivered work is licensed to you for internal review only and may not be published, used in production, or relied upon commercially. On full payment, full copyright and usage rights in the delivered work transfer to you, except for any pre-existing third-party assets (fonts, stock material, licensed components) that remain subject to their own licence terms, which we will identify. We may reference completed client work in our own portfolio only with your prior agreement; our six published concept case studies are self-initiated studio work, not client deliverables, and are shown under our own rights.

10 Confidentiality

Each party keeps the other's non-public business information confidential, using it only to perform the contract, both during the engagement and after it ends.

11 Liability

designplatinum is liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence, liability is limited to foreseeable damage typical for this kind of contract. Liability for indirect or consequential loss is excluded to the extent permitted by German law. Nothing in this clause limits liability under mandatory statutory provisions, including the German Product Liability Act.

12 Cancellation

Cancellation, refund and the statutory consumer right of withdrawal are set out in full at /legal/refund/, which forms part of these terms.

13 Governing law & venue

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. For business customers, the exclusive place of jurisdiction is Frankfurt am Main. Statutory consumer-protection rights and venues are unaffected.

14 Severability

If any provision of these terms is held invalid, the remaining provisions continue to apply, and the invalid provision is replaced by one that most closely achieves its intended purpose.
